I was searching through Henderson's Roster of Confederate Soldiers of
Georgia and found in Company G 32nd Georgia, a Joseph L. Oats. This rifle
company was organized in Emanuel County. Could this be one of ours.

I wish I could say that the James Oates whose will was probated in Yorkshire
in 1608 was related to our James, but am not certain. Yorkshire is a huge
place. Leeds, York, Durham are all in this shire. After King Edgar of
Northumbria died in 896 A.D. the Norsemen conquered the place. I think there
is also a town or I should say city by that name. Do you think Lorene would
mind if I contacted her. I cannot recall the name of the person who told me
that there was a James Oates whose will was probated in 1608, there was
also a Joseph who was born in 1713 there.

Christmas. What have you found out about John Oates brother to Susannar

Carraway. Also wanted to pass this along this from a member of the

I have a copy of a book by Weynette Parks Haun called "Old Albemarle County

North Carolina Perquimans Precinct Court Minutes - 1688 thru 1738.

In this book there are two court cases involving people you mentioned in

your request.

"At a Court holden for the Precinct of Perquimins the firt Monday in (torn)

1690// at the house of Mary SCOT: Present Capt. Ralph FLETCHER Steward,

Mr. John WHITBY, Mr. William BUNDY, Mr. Joseph SUTTON, Mr. Robert WILSON,

Justices.

"Richard EVANS in behalf of John LILLy petitioninge the Court in October

last, that Thomas ATTAWAY should give an account of the cattle belonginge to

the orphants of John LILLY, deceased, & why he detaines the same who hath

produced a writinge from John LILLY deceased which gives the sd. ATTAWAY

power to Keep the sd. Orphants & stock, both of Thomas LILLY & his Brother

till they come at age of twenty one yeares old, It is therefore Ordered

that Thomas ATTAWAY give account of what Cattle belongeth to Tho: LILLY, &

William LILLY (after John LILLY have his part) & give bond to the Court for

the mannaginge, & deliveryof the same accordinge to condition:

" Thomas ATTAWAY commencinge sute agt John LILLY, & the Jury finding for the

defendt. Therefore it is Ordered that Thomas ATTAWAY & John LILLY choose

each of them a man to divide to John LILLY what cattle as can make appeare

to be his out of the stock of John LILLY deceased & that Thomas ATTAWAY,

give an account of what Cattle, belonge to Thomas LILLY & William LILLY, &

give bond to the Court, for them & their increase, casualties, Excepted, for

the use of the sd. Orphans."

No. 119-80 on page 48

"The Docktt. of actions for the prcinct Courte of Pequimins to be held att

ye house of Capt. James COLE ye 2d. Friday in Ffebruary 1702/3.

extd. James OATES and Eliz. his Wife Joynt Admrs on the Estate of Jno.

LILLY vers. Jno MORGAN in a plea of dt. Jany, the 29th."

No. 123-84 on page 50

" At a Court held at the house of Captt. James COLE the 2d. Tuesday in

February for the prcinct of Perquimans being ye 9th day. (no date given)

James OATES Come to prosecute his suite agt. Jno. MORGAN the sd. Jno. MORGAN

appearing Confesses Judgemt. Ordered that Jno. MORGAN pay unto James OATES

Nine & thirty Shill. wth Cost of Suite als. execution."

I can't find anything else regarding a lawsuit between these people. Don't

Samuel K. OATES SR. was born in South Carolina in 1796. He married Amelia GRIFFIN. THey had the following children.
Oliver Hilliard, Samuel K. Jr., David C., Wyatt C., William C., John T. James C. Harry H., all born in South Carolina. These may not be in order of their birth. Samuel Sr.'s mother Fannie is buried in the OATS Cemetery in Barton. John T. and Oliver H. are buried in Helena Ark. Phillips Co. in Confederate Rest. JOhn T. died in 1894. His tombstone reads Col. John T. OATES. Oliver H. is Captain Oliver H. OATS CO. A 25th Ark Inf. Samuel K Jr. served in King's Battalion Ky Cav. He resigned to run for political office in 1863 to represent Franklin Co. ALabama in the Alabama General Assembly. He was assissinated before he was sworn in. Wyatt C. was in Co. A 2nd Ark Inf. William C. In Co. H Crockett's Rifles 1st Ark Inf. Harry was a Lieutenant in Co. L 4th Alabama Cav. David C. was in Company D 40th Alabama Inf. I have not located the unit James was in. I do not know if these are interred in the OATS Cemetery or not. Someone told me that only 4 of Samuel K. Sr.'a and Amelia sons are interred there. The Col. William A. Johnson Camp SCV had expressed an interest in restoring it, but they had other projects they have not completed. David OATES of Lufkin Texas was trying to get someone to help protect it. He is descended from Wyatt C. OATES.

I think most of the OATES family from South Carolina are descended from Stephenson and Pharibia OATES of Darlington Distrect S.C. Stephenson was born in Wayne County North Carolina in 1764 he married Pharibia CARRAWAY in 1783 in Sampson County their eldest children born from 1784 to 1800 were born in Moore County. The family moved to Darlington around 1802. James's grandson William James was funder of the town of OATES. Stephenson died in 1817. Stephenson had a brother Samuel that also died in South Carolina in Fairfield in 1801. He married Fannie CANNON. They had six children. Fannie OATES was born in 1762 Sam in 1760. She died in Northwest Alabama in 1841. The cemetery in Barton Alabama needs saving grave robbing and vandalism needs to stop. Any suggestions.
